JoinSpot organiser terms

These terms apply as soon as you set up your account to receive money on JoinSpot. By ticking the acceptance box, you accept everything below. We record the date and the version you accepted.

1. Who does what

You organise the event and you are responsible for it: its content, how it runs, its safety, and compliance with the laws and regulations that apply to it.

JoinSpot provides the app and collects payments on your behalf, through Stripe. JoinSpot does not organise your event and is not answerable for it.

2. Your payment account

To receive money, you must create a Stripe account linked to JoinSpot and provide the information Stripe requires. Until Stripe has verified your account, no payout is possible.

Stripe's terms apply in addition to these terms.

One payment account per organiser. You may not collect money on behalf of another person.

3. Price and fees

You set the price of your tickets. JoinSpot adds a service fee of 3% + $0.99 per ticket, paid by the buyer on top of the price.

Example: for a $10.00 ticket, the buyer pays $11.29, and $10.00 goes to you.

This service fee is never charged to you. The amounts you may owe are described in sections 6 and 7.

JoinSpot may change its service fee. The change applies only to events created afterwards, and you are notified at least 30 days in advance.

4. When you get paid

Ticket money is held until the event is over. The payout is prepared after the end date, then sent to your bank account by Stripe, which usually takes a few business days.

Before your first payout, JoinSpot reviews your account. This review can take a few days.

JoinSpot holds back the ticket money of your upcoming events, so that buyers can be refunded if one of them is cancelled. A payout can therefore never dip into that reserve. Whatever is not paid out for this reason remains owed to you and goes out with the next payout.

A payout may be held while a payment dispute is open, while a report concerns your event, while Stripe asks for information, or if your account shows a risk of fraud.

5. Refunds to buyers

You choose the refund policy of each event, among those the app offers. It is shown to the buyer before purchase.

Within the time that policy allows, the buyer can cancel their ticket themselves. They get the ticket price back. JoinSpot's service fee is not refunded to them.

6. If you cancel your event

All buyers are refunded automatically, service fee included, with nothing for you to do. You can undo your cancellation within 24 hours; after that, the refunds go out.

Tickets already scanned at the door are not refunded automatically. If the event was cancelled once under way, write to us and we will sort it out with you.

Stripe never returns its processing fees on a refund. Those fees are yours to bear when the cancellation comes from you. They are about 2.9% + $0.30 per ticket and are recovered under section 8.

7. Payment disputes

A buyer can dispute their payment with their bank. The payout tied to the event is held while the dispute is open. We may ask you for the information needed to respond, and you agree to provide it without delay.

If the dispute is decided against you, you owe us the ticket amount, the dispute fee charged by Stripe, about $15, and the processing fees that were not returned.

If it is decided in your favour, nothing is charged to you and the payout resumes.

8. Amounts you owe JoinSpot

By accepting these terms, you authorise JoinSpot to recover the amounts in sections 6 and 7, in this order:

  1. by withholding from your upcoming payouts;
  2. if you have no upcoming payout, by debiting the balance of your Stripe account linked to JoinSpot;
  3. failing that, by any other lawful means.

Every withholding and every debit appears in your Stripe dashboard, with its date and amount. If you dispute an amount, write to us within 30 days of that movement.

9. Your obligations

  • Hold the event as announced, at the place and time announced, or cancel it without delay.
  • Describe the event accurately, including its price and its access conditions.
  • Obtain the permits, insurance and authorisations required.
  • Comply with applicable laws, including those on alcohol, venue safety and the minimum age of participants.
  • Do not sell tickets for an event you do not actually organise.
  • Treat participants with respect and answer their questions.

10. Suspension

JoinSpot may suspend your sales, hold your payouts or close your access if you do not comply with these terms, if serious reports concern your events, or if fraud is suspected. Buyers are then refunded for events that did not take place.

11. Your data

JoinSpot handles your information in accordance with its privacy policy and with Quebec's law on the protection of personal information.

If you delete your account, your personal information is deleted, but financial records (sales, refunds, amounts owed) are kept for as long as accounting and tax obligations require, and dispute evidence until the dispute is closed.

12. Liability

JoinSpot provides the app as is and does not guarantee a number of participants, any revenue, or uninterrupted operation.

You are answerable for damages related to your event and for participants' claims arising from it.

13. Changes to these terms

JoinSpot may change these terms. A new version will be presented to you for acceptance before your next sale. Until you accept it, you can receive payouts already owed to you, but you cannot sell new tickets.

14. Governing law

These terms are governed by the law of Quebec, and the courts of the district of Longueuil have jurisdiction.
